LANDMARK DECISION in Industrial Relations

The Court of Appeal, on the 17th June 2013, decided once more in favour of the Civil Protection Association and rejected the application filed by the Government of Malta asking for a retrial of the case.

The Civil Protection Association of Malta had filed proceedings against the Government asking the Court to order the Government to set up the Joint Negotiating Council. The Law provided for the establishment of this Council since 1976, with the scope of giving particular employees the right to seek redress before the Council in cases of industrial disagreement, but successive Governments failed to constitute same Council.

It is now hoped that the Government will abide by the Court decision and appoint the Council within four months as ordered by the Court.

The Civil Protection Association of Malta was represented in these proceedings by Dr Ian Spiteri Bailey and Dr Edward Gatt.
